What happened

Kate (not her real name) is an employer who had been experiencing several ongoing issues with a member of staff and decided to terminate the staff member’s employment. The employee consequently filed a claim in the employment tribunal, claiming unfair dismissal and disability discrimination.

How we helped

Our employment law team was able to assist Kate in drafting a response to the claim and provide support and guidance throughout the entire tribunal process. This included advising on correspondence received from the tribunal, assisting with completing the case management agenda and preparation of a bundle of documents for the hearing.

The outcome

The matter was resolved amicably via a negotiated settlement, without the need for either party to attend the tribunal hearing.

Key learnings for our members

  • Employers should notify the AOP as soon as possible if you receive a claim form or any correspondence from an employment tribunal. Failure to respond to a claim form within a legal deadline may mean judgement will be made against you
  • The AOP employment team can advise and assist both employer and employee members with employment tribunal matters. Where both request our assistance with the same matter, we are able to manage the conflicting interests of the parties by instructing different solicitors
