Flexible working is a key issue for members and the AOP has provided a template flexible working policy that members can use and adapt for their own practice.

Key Points for Employees

  • Employees with at least 26 weeks’ service have a statutory right to request flexible working. Only one request can be made in a 12 month period
  • Employers do not have agree to these requests but they must consider requests in a reasonable manner and can only refuse flexible working requests for a legitimate business reason
  • If you have made a flexible working request or wish to do so, it is important that you obtain a copy of your employer’s flexible working policy

Under this policy, you may need to take certain steps to ensure your request is considered, such as submitting a request on a particular form.  In addition, you will then be aware of how your employer will deal with your request

Key Points for Employers

  • A written flexible working policy will help you ensure you meet your legal obligation to deal with flexible working requests in a reasonable manner.  A written policy also ensures consistency and minimises the risk of managers treating employees inconsistently
  • Employers should only refuse flexible working requests for one of eight business reasons and should offer employees a right of appeal
  • Employers should ensure that all managers are trained and aware of the right policies to follow if an employee asked about flexible working
